Welcome to H3 Fleet Forecast (“Company,” “we,” “us,” or “our”), powered by H3 Fuel Services. These Terms of Service (“Terms”) govern your access to and use of our website at h3fleetforecast.com (the “Site”), our mobile applications (the “App”), and all related software, services, and daily fuel forecasting tools (collectively, the “Services”).

By accessing or using the Site or App, or by enrolling a fleet in our subscription plans, you (“Client,” “Fleet Administrator,” or “User”) agree to be bound by these Terms. If you are accepting these Terms on behalf of a business or fleet entity, you represent and warrant that you have the authority to bind that entity.

1. Description of Services

H3 Fleet Forecast provides commercial fleet operators and commercial drivers with market analysis and daily price recommendations (BUY or WAIT alerts) designed to optimize diesel fuel purchasing timing.

  • Fleet Subscriptions: Subscriptions are categorized by fleet size tiers (e.g., 50–100 trucks, 101–200 trucks).

  • Private & Invite-Only Access: The App is a private, invite-only system. Fleet Administrators invite authorized drivers, who must enable push notifications to receive daily price recommendations.

2. Market Recommendations & Savings Disclaimer

  • Recommendation Nature: Daily BUY or WAIT guidance is derived from diesel market analysis, regional trends, and forecasting models. All forecasts represent estimates and opinions rather than guaranteed financial outcomes.

  • No Guarantee of Savings: References to potential savings (e.g., “up to $0.10 per gallon” or projected monthly/annual savings) are estimates for illustrative purposes. Actual savings vary based on market volatility, actual fuel purchasing behavior, local fuel vendor pricing, and driver compliance.

  • Independent Commercial Judgment: Users and Fleet Administrators maintain sole discretion over actual fuel purchases. H3 Fleet Forecast and H3 Fuel Services accept no liability for financial loss, price increases, or operational decisions resulting from reliance on daily recommendations.

3. Account Registration & Private Access

  • Eligibility: You must be at least 18 years old and authorized to represent a commercial transportation entity or fleet.

  • Account Security: Fleet Administrators are responsible for maintaining the confidentiality of administrative credentials and for managing driver invitation lists.

  • Authorized Driver Use: Drivers may only access the App via a valid invitation link issued by their company. Sharing login credentials, access links, or daily recommendations with unauthorized third parties outside your fleet is strictly prohibited.

4. Billing, Subscriptions, and Cancellation

  • Subscription Fees: Fees are billed monthly according to the fleet tier selected during sign-up.

  • Promotional Offers: First-month free promotions apply only to eligible new fleet accounts.

  • No Long-Term Contracts & Cancellation: Services are provided on a month-to-month basis without long-term commitments. You may cancel your subscription at any time prior to the next billing cycle by contacting customer support or managing your account settings. Refunds are not issued for partial billing periods unless required by law.

5. Mobile App Usage & Safe Driving Compliance

  • Driver Safety Notice: Drivers must NEVER use, check, or interact with the App while operating a moving motor vehicle. All interactions with daily recommendations (e.g., confirming “I bought fuel” or “I waited”) must occur while the vehicle is safely parked in compliance with applicable traffic laws and Federal Motor Carrier Safety Administration (FMCSA) guidelines.

  • Push Notifications: The primary functionality of the App relies on push notifications. It is the User’s responsibility to ensure notifications remain enabled on their device.

6. Intellectual Property & Restricted Use

  • Ownership: All content, software, forecasting algorithms, trade names, branding (including “H3 Fleet Forecast”), and logos are the exclusive property of H3 Fleet Forecast and H3 Fuel Services.

  • Restrictions: You agree not to:

    • Reverse engineer, decompile, or copy the App or forecasting algorithms.

    • Resell, syndicate, or publicly redistribute daily BUY/WAIT recommendations.

    • Use the platform to build a competing fuel advisory service.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL H3 FLEET FORECAST, H3 FUEL SERVICES, OR THEIR AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DOWNTIME, OR FUEL COST DIFFERENTIALS) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, APP, OR DAILY RECOMMENDATIONS.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT DAILY RECOMMENDATIONS WILL ALWAYS PREDICT EXACT MARKET MOVEMENTS OR THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Termination

We reserve the right to suspend or terminate your account or access to the App at any time if you violate these Terms, share private invite access with unauthorized parties, or fail to pay applicable subscription fees.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state in which H3 Fuel Services operates, without regard to its conflict of law principles.

11. Changes to Terms

We reserve the right to update or modify these Terms at any time. Material changes will be communicated via the Site, the App, or by email. Continued use of the Services following notice of changes constitutes acceptance of the revised Terms.
